    A Legal Document Assistant (LDA) is a California-licensed professional who prepares and files legal documents at your direction—without providing legal advice. Here's what LDAs are, what they can and cannot do, and how to verify one is legitimate.

    Who Regulates Legal Document Assistants in California?

    Legal Document Assistants are registered and regulated under California Business and Professions Code § 6400–6411. They must register with their county clerk and maintain a surety bond.

    Registration Requirement

    Every LDA must register with the county clerk in which they operate and file renewal paperwork annually.

    Surety Bond Requirement (B&P § 6405)

    LDAs must post a surety bond protecting clients from fraud or negligence:

    Disclosure to Clients

    What Legal Document Assistants CANNOT Do

    Cannot Provide Legal Advice

    LDAs cannot tell you which legal path is 'best' for your situation, recommend a strategy, or interpret the law. That's the role of an attorney.

    Cannot Represent You in Court

    If a judge calls your name, an LDA cannot stand with you or answer on your behalf. You must appear and represent yourself, or hire an attorney.

    Cannot Handle Contested Matters

    If there's a dispute, disagreement, or litigation, you need an attorney. LDAs work only on straightforward, uncontested matters.

    Cannot Negotiate on Your Behalf

    An LDA prepares what you tell them to prepare. They cannot negotiate a settlement, draft a settlement agreement, or handle mediation.

    How to Verify an LDA Is Legitimate

    Step 1: Check Registration with County Clerk

    Contact the county clerk's office where the LDA operates (e.g., San Diego County Clerk, Oceanside office). Ask if they are registered under B&P § 6402 and request their registration number.

    Step 2: Verify Surety Bond

    Ask the county clerk to confirm the LDA maintains a current $25,000 surety bond (or higher, depending on number of operators). Request the bond number.

    Step 3: Ask for Written Disclosure

    Legitimate LDAs will provide written notice (per B&P § 6411) stating they are not a law firm and cannot provide legal advice. If they don't have this, walk away.

    Ask for client references or reviews. Legitimate LDAs are willing to share satisfied clients (who consent).
